Having watched the incident on tv i think it was a bit of a silly play from Tomkins, he did try to use his knee in my opinion to probably put his weight on Buderus' calf, something that can be very painful especially if you are 16 stone plus. I do not think it was malicious he was just wanting to let him know he was there, there was a bit of intent in my opinion, but it was a bit half hearted which is why he probably has no case to answer, would have been a very silly play had he fully committed to it and ended up sitting out the Saints game.
