The alternative being that it's OK to financially discriminate on the grounds of sex?
If Birmingham CC, other councils and many private companies hadn't made provision for such a judgement, then it is they who are to blame. Similarly, if they hadn't practised discrimination in the first place, there wouldn't be such a palaver now. The councillors involved should have their assets seized, it's not that unusual

The issue is that, by extending the time limit from 6 months in the ET to 6 years in the courts, the floodgates of litigation may have been well and truly opened. Cases will no doubt be launched by ex employees against employers who thought any such claims were long time-barred.
Employment lawyers will be rubbing their hands with glee.

Remember that unlike an employment tribunal if you lose in court you usually have to pay costs and the cost to take a case to court would bar lost of spurious claims.

What many are conveniently forgeting is that taking an employment discrimination case through the courts, as opposed to an industrial tribunal, has always been an option. As I found out to my cost around ten years ago.

| I'm all for equal pay for equal work. But, that should mean taking account of, for example, time wasted talking and going to the toilet. Men are probably underpaid relative to women taking those things into account.

| Equal pay should be a given if it is the same job - problem is if you have pay bands so 25,000-27,500 how do you pay for greater ability/experience within that band. Given some of this will be subjective how do you reward correctly without claims of discrimination?
The biggest discrimination of all is the pensionable age - why is this not the same for both sexes?

| Anyone who says men and women should not be paid the same rate for the same work is stupid, in my opinion.
And given that the equal pay laws have been around for a long time now, it shouldn't matter whether the claim cut off is six months, six years or six hundred years. Firms have had enough time to get used to it, let's face it.

| Equal pay is an easy concept when you are talking about waiting tables or stacking shelves.
As someone else has pointed out, quite a lot of jobs will have pay bands, and the employees will be remunerated depending on qualifications and experience. Even though both are doing substantively the same work.
The place I work operates a pay band system based on time served. The person whom I share an office with, who happens to be female, has been around longer and is paid a few thousand more than me for no other reason than she has been here longer. We do exactly the same job. Should I launch an equal pay claim?

Same here, we have grades of pay scales and you move up them with experience, professional status and service, starting at 80% of full grade. There are a few women who earn less than me for much the same job and a few who earn more.
