It would have been interesting to see if the penalty would have stood up in a court of law, I don't think it's clear cut that it would. However we didn't pursue it, it was the final straw for Maurice and DW with the RFL, and we are were we are today, which is actually a good thing in my book.

These idiots need to take a closer look at other sports.. In the NFL for instance, deferred payments are common practice and completely acceptable. We did not break any rules at the time, we merely followed the trend set by other sports that made salary caps so popular in the first place!

He're an example:

Player A Is contracted to earn £100k per year for 3 years, so a total of £300K over his contract. £100k may count per year on the Salary cap. What Wigan did was NOT PAY the player part of his salary that year (with the full agreement of the player, so essentially a paycut), so lets say pay him £50k in year 1 and count £50k on the salary cap (the amount we were paying him), and pay him £150k in year 2 and count £150k in year 2's cap, and pay him 100k in year 3 and count £100k in year 3's cap.

Can you get it? The total amount of salary paid was within the cap that year, what the RFL did was force us to count on the cap the full year 1 salary (even though the player was not earning the money).

The following year the RLF changed the rules and put in a specific rule to not allow defered payments, even if logically a lot of people feel it's a completely stupid rule, as it's now a rule everybody follows it. There are several things that are and have been 'against the spirit' of the cap, including image rights payments, NI contribution avoiding via overseas loopholes etc, and the clubs using them didn't get penalised as there was no rule - they have since been in trouble with HMRC, but even now not the RFL (because no rule was broken)

No, if you read back, I said we didn't break a rule - and that we took a punishment for breaking a 'spirit' and moved on. Unlike the idiots who continue to have digs about us breaking every rule in the book to stay up, when in fact we broke non.

Was reading the thread from the end in reverse and was thinking of totally ignoring your complete and utter drivel regarding the "Spirit" of the Cap of a couple of seasons ago when I came along this little Gem!

Seeing as the last 4/5 times I've been to Wakefield I seem to recall virtually half the attendance being made up of Wigan Fans and on your return visits to Wigan you lot Chartering a 10 seater mini bus it really does make myself wonder as to the reasons for your lots lack of support at away games (And Home for that matter!).

I saw approx 10 Wine & Spirit bottles left stood up outside the Various Takeaway shops behind the away end whilst walking to the game on Sunday so alchoholism could be one factor?
Maybe your lot must have to do Way More community service than our lot so that may keep the numbers drastically low?
Your lot recognise your own ground as a 5h1t hole so you stay away from home games and going to away games makes you green with envy so you stay away from them as well?
You are from Yarkshire so a large majority think you may actually fall off the end of the earth if you go beyond the Pennines?
You think you may need your passport & Money changing to come to Lancashire so can't be bothered?
