Wondered that myself, thought Dave Whelan owned the stadium outright.

Didn't he hand ownership to Wigan Athletic?

The Council holds 10,214,000 fully paid £1 ordinary shares in Manchester Airport plc, 5% of the
issued shares.
Wigan Football Company operates the DW Stadium (formerly the JJB Stadium) at Robin Park,
Wigan. The Council holds 4,499,492 ordinary £1 shares in the Wigan Football Company which
are 15% of the total issued.

Council still have a shareholding in DWS and the 'handover' has never happened.
