| As part of the development of industrial units at Newmarket the developer made an S106 agreement to build a new community sports facility there, which included a new ground with Wakefield Trinity as anchor tenants.
Such a commitment, handed on a silver plate could never go wrong right? Plenty of other Councils have done the same thing.
Step up Wakefield Council, in particular Mr Box the Council Leader. He and his Officers have permitted a massive development to take place there that is outside the 106 agreement - is this even legal?
Why would a local council leader not want to put his every effort into implementing such a massive community benefit in his local area ?
Wakefield must be the only Council ever to have overseen such a massive failure of a 106 agreement. Was it just incompetence or is there something more sinister going on?

| Basically yes it does as the Council has permitted a separate application that circumvent the agreement to provide the community facilities. Furthermore, they did not indicate that it was outside the agreement until it was too late to object, and that notification was only via an obscure document that only the council members had a realistic chance of seeing.

| Not sure WMDC know their arris from their elbow. How else can you explain their recent granting of (outline) permission for the building of a retail park (including a food store) and expansion of an existing large supermarket in Glasshoughton whilst, at the same time, denying permission for a smaller sized supermarket in the same area because it would “significantly impact” trade in Castleford town centre?

Did you not think that maybe the club getting shafted by both the developer & the Council could actually affect things at the club?
Or do you really believe the relevant parties in the stitch-up could actually see into the future, to tonight’s game, & formulate a plan to wriggle out of their obligations .

| Whatever the legalities of the Current development being outside the 106 it would still not have triggered the stadium build.

Nope, but it would have been a start & now a precedent has been set, who knows what future proposals could be circumvented.

Absolutely! If the developer does try it again I have no doubt the response from WMDC and the Club/Trust would be a little more robust!

I’m afraid I do!
If a Tin Pot organisation has run rings round a M.D.C, they could probably do it again, we’re hardly talking about the Brain Trust here – it’s Wakefield Met .

Someone took there eyes off the ball when the plans were submitted ! WMDC /club/ glover/ sir Rod/ stadium trust ! - Take your pick ! The clue was in this - "the application is a stand alone and is in no way legally tied to the extant outline consent for the site" No one from the clubs side picked up on that, or questioned its meaning in relation to the s106 agreement (afaik). If they had, then things may have panned out differently !

It may have not got built, but I doubt it would've made a jot of difference when it comes to the building of a stadium. If Yorkcourt hadn't managed to pull this fast one I imagine they would've looked to sell on the land with PP and pass on the obligation to another developer.
They never had any intention of building a stadium in my view, I would be intrigued to know how much WMDC knew of this apparent intention. Their threat of legal action against volunteers who are trying to work out what has happened and their refusal to providing information requested via FOI smells rotten to me. Either way there will still be no stadium at the end of it as no one has the money to pay for one.

The S106 obligation is still valid for the rest of the site which has plenty of plots to trigger it. The test will be how the developer submits future applications in relation to that.
Whether the developer ever intended to build a stadium is a good point, something which "some people" warned about over 5 years ago !

They will either follow the precedent and chance their arm again or bide their time until the need for a new stadium, at NM or otherwise, goes away.

Glass houses and stones, you of all people shouldn't be throwing them
What would your crowd be if you were at the bottom, you know, like you always used to be.

| Is there some sort of forcefield on the pennines that ensures competent stadium builders and council officials stay out west?
On one side you've Leigh, Saints and Wire with lovely grounds getting built, and on the other you have Bulls, Wakey and Cas struggling to get out of, or otherwise update their dilapidated holes in the face of ineptitude and shysters.

Halifax are a bit of a fart in the face of that theory. Cracking little ground they've got over there.

Now it is but it lay half built for years. And that was down to our patented Yorkshire incompetence.
