Id say your right on both counts, hes a numpty and has let so many people down,
We all mess up on occasions but not on a regular basis, god only knows what his team mates think of him,tbh hes gone to far and should be shown the door, after all it is a sackable offence.guess he doesnt know how lucky he is to play our great game and earn the kind of money he does.
now agar has the backing of the fans he might of done the right thing and got rid.

tbh wolfie, considering he could have cost us a decent shot at a play-off win last year and knows this time his actions could leave us even further up the creek without a paddle squadwise, I'd be happy to boo him. The last time I booed a player on my team was at Wembley when Shaun Edwards got sent off for Great Britain.

I sincerely hope you never get the opportunity, for a couple of reasons:
1 - I detest seeing anyone boo a player from his/her own team
2 - I sincerely hope that no one is given even the slightest opportunity to boo him, in a black & white shirt.
No player should ever be considered bigger than the club, allowing Tansey to remain would send out the opposite message. Why should any player in the future not consider himself indespensible?
If and I really hope it doesn't happen, he stays, then I would much prefer a total silence to descend on the KC, whenever he entered the field or touched a ball.

| Hypothetically speaking, lets say Tansey gets the sack.
He'll then be entitled to an appeal which may take a week or so.
Whether that appeal is successful or not may depend on whether we are able to sign anyone else in the meantime.
Or am I being too cynical?
Or attributing our board with a level of cunning it doesn't have?

In my view, this is the third time he's let us down and his teammates down. The only scenario planning required is whether we play him or not, should we be unable to sack him due to a technicality.

| On the field Tansey is an exciting talent and personally I regard the pluses far outweigh the minuses, particularly in a team lacking flair and creativity which he brings in spades.
Off the field his record of letting his club, team mates and fans down is second to none, and for that reason HE HAS TO GO.

| the club has said he was on his last warning, which suggests a verbal warning and a written warning have been issued and now the club can sack him for gross misconduct? So you think Tansey would waste time on an appeal, or just find a new club?

I'm sure the club has the grounds to sack him if it wants to.
The question is does it have the will to sack him?

Fairly simple process really.
1st warning for offence - done
2nd and final warning for similar offence - done
3rd indiscretion - dismiss. To be done
Right of appeal - this would be heard independantly within the club. At this point Tansey would normally become an ex-employee and if he wins his appeal we'd need to re-employ him. On that basis we'd need to keep cap space free should we need to do so.
If his appeal fails he can finally take us to an employment tribunal. There are various remedies available but it's likely at this stage if we lost we'd pay him compensation rather than having to re-employ him. Maybe the club are trying to find out whether this compensation payment would count on the salary cap or not. If not we can dismiss and now that once past appeal stage we can use the cap space on someone else.
Thinking about it all, we aren't going to be able to use the Tansey can for some months pending an appeal/tribunal even if we do dismiss for fear of having to re-employ or pay compensation.
This is why as i said earlier in the thread maybe we will compromise him instead and give him a pay off. Allows us to use the space cap immediately and forces Tansey to keep quiet about the situation.

I dont, but those are the accepted best practice principles by law. If a business doesnt follow those principles they will have been found to have acted inappropriately when dismissing. Everyone has the right of appeal and everyone has the right of a tribunal by law.
It's been documented that this is his 3rd indiscretion and he's received formal warnings previously.

Just because they are accepted best practice, doesn't mean they are in place at Hull. I would suspect that the employee T&C's at a pro sports club are quite specific to the job.
Having said that, I hope you are right and they can and do sack him

Terms & Conditions of employment generally have nothing to do with disciplinary procudures. Even professional sports people and clubs are bound by UK Law around what constitutes unfair or constructive dismissal claims. Therefore best practice is actually more than best practice. If Hull FC have not followed the guidelines set out by ACAS they could well find themselves in hot water.

Well if a decision needs ratifying they should call an emergency board meeting. It's a pretty significant issue. I'd hope Jimmy Rule could make the decision without having to consult the board.

Terms and conditions/policies and procedures. Whatever, I'm guessing that a business with a £5m turnover took some legal advice when drawing them up and will be on solid ground when they make their decision.
