No worries. I suspect that a draft of the 106 Agreement will have been circulating between the parties. YC will have submitted a draft but the SoS will not grant formal consent until the document is signed and sealed.

Right, panic over!

I have now been made party to a letter from Gateley (Yorkcourt's Agent) to the SoS office dated 29th August 2012.

It is just a simple legal issue that is holding up the actual dating and formal final completion of the 106 agreement. The section 106 has indeed been signed by all parties, the Bank, the land owner and the applicant and the SoS office have a copy but this copy is currently undated! It can't be dated because completion of it has to be simultaneous with the completion of a contract for the acquisition of the stadium site by the applicant from the current land owner.

So the letter basically asks for a short period of additional time, which is necessary to allow the completion of the land transaction. It would appear from the letter that the SoS officers are aware of the issue and they have clearly being discussing this issue with Gateley and all this letter is just a formal confirmation of such.

So there you go! If someone would like to post this on any other forums, please feel free.

Maybe from Yorkcourts perspective keeping you in the loop a little better (and earlier!) over matters such as this when deadlines are going to be affected might be an idea to head off any bad press towards them. Remember ater all the crap us wakey fans have been through regarding stadia in the past its natural to be a little touchy! We just want the sodding thing built!!

I think they are just guilty of doing this type of stuff all the time and to them it is no big deal, it is just something that needs resolving. They don't do it on purpose by any means, I just think that they might not fully appreciate just how much scrutiny they and others are being put under on forums, twitter etc.

I get the impression that it is just waiting (probably for yet another set of lawyers) to get this land transaction finally sorted out. As it will have been under option subject to planning, then actually getting this land transaction sorted and finalised in just 4 weeks has probably just proved elusive. I would think the SoS office will be wanting (and getting) regular updates on progress but don't think an hard and fast deadline will have been set, given that the SoS office would appear to be happy with everything other than getting the dated version of the S106 agreement.

As an aside, the LDF sites plan went before the council this afternoon for final ratification and adoption. I would expect therefore it was indeed ratified and adopted and that a large part of the development site is now finally formally removed from Green Belt!
