Yep, it took him quite a while to come up with that response, and it only came after I didn't let him avoid answering any longer. It makes you wonder if he'd been in touch with our illustrious council leader for a suitable answer...

It's pretty much the same response I got from Peter Box on Radio Leeds so we can draw our own conclusions on that.

What are S.106 Agreements?

As part of the planning process, the Council and a developer seeking planning permission may enter into a legal agreement – usually following Planning Applications Committee (PAC) recommendation to grant planning permission subject to such an agreement being entered into – that will set out the terms for the developer to provide or fund the provision of infrastructure, services or other impact mitigation measures on or off the development site. This agreement is referred to as a “Section 106 Agreement or Planning Obligation”.

What are Unilateral Undertakings?

A unilateral undertaking like a S.106 agreement is a legal deed where developers covenant to perform planning obligations however unlike S.106 agreements they don’t have to be entered into by the local authority. A unilateral undertaking comes into effect when planning permission to which they are linked is granted.


I also found some extracts from the actual Unilateral Agreement which seems to suggest that:

The unilateral agreement is issued under section 106 of the Town and Country Planning Act and whilst Council is not a party to the unilateral undertaking it clearly has obligations under the agreement. (As do [ithe Trust[/i and kind of suggests it is legally binding).

The agreement also refers to 'reasonable practicability' in expediting requirements of the agreement.

That councillor clearly has no grasp of a unilateral undertaking.

An agreement is a contract between two people to arrive at an agreed end point, and it is actionable by either party should the two-way agreement not be satisfied.

A unilateral undertaking is a promise by one party that is relied upon by the other, and who follows a certain course of conduct as a result. As such, it is actionable by the party to whom the undertaking is given.

He is just quoting the party line. Any Councillor asked will answer the same way.

The Unilateral Undertaking is persuant to Section 106 of the Town & Country Planning Act and is therefore a Section 106 Agreement. It is given by Yorkcourt to Wakefield MDC so as you say is a legally enforceable contact between Yorkcourt and the Council.

Yes, I met with him and other councillors from that ward - they did not want to know let alone get involved!

The Councillors are yes men, Box is a dictator he runs the council as his own personnel Fiefdom. He decides which Councillors get to stand in which ward, he plays the numbers games brilliantly, he knows that he can put anybody up for election in many of the wards in our area and that person will get in, because most of his Councillors are weak minded greedy parasites they follow exactly what box tells then to do. In return they keep their safe seat and reap all the financial benefits, £ 30,000 expense money each year is a fortune to many of them. Then if they do as they are told and follow Boxes line they get a more lucrative position say on the cabinet when they can claim even more. At the back of their greedy minds they know that if they went with their conscious and spoke the truth or God forbid question Box then they lose their positions and their financial rewards. Then you have the paid officials who are on absolute fortunes, Joanne Rooney and her ilk on £ 150,000 plus per year. So Box knows that he can bully his employees and his Councillors. The last man to question him was the ex Chief Executive who was call Foster, guess what he was sacked by Box and guess what Foster went on to win a £ 500,000 wrongful dismissal case, no bother to Box as the tax payer picked up the bill. Box knows that his Councillors are weak minded and that they rely on the money and more importantly the Councillors know that Box has it within his gift to make or break them. Local politics at its bullying corrupt worst.
