| I have seen threads on this in the past but couldn't find it so if you don't mind I've atrted this new one.
I recieved a parking ticket from our good friends CMS back in Febuary whilst attending the World Club Challenge, and when reading on here people were saying ignore it and they'll go away as its not enforceable. However today, I have recieved a 'notice of intended litigation'. Shall I still go ahead and ignore this?
Also I have no idea on whether this has any bearing on the matter but in any correspondence on this matter they have spelt my name wrong, so in theory my name isn't the one the letter is being addressed to.
Anyone have any advice.

| Hi mate, I think it's a myth that if your names spelt wrong you get off. If you're car reg was wrong you'd be in the clear, but courts have powers of ammendment on this I think.
I'd post it in the sin bin, there's always knowledgeable people on there on these kinds of things.

| I had one of these and was about to pay until I googled it. There are loads of threads about these company's who send you an invoice for parking, they have no authority to fine you. They work on a model where a certain amount of people will simply pay, those who don't receive three letters, each getting more threatening. After that they give up, they haven't taken anyone to court because the process is too long winded and expensive and losing a case would blow their whole business case out of the water. Ignore the letters, and they will go away. Check out the money saving expert website forums for loads of threads on these con men.

| Wouldn't bother posting it on the sin bin.
I posted one about a month ago and most of the replies were telling me I'm a menace to the road etc..... The sin bin seems full of self rightous morons.
Rant over
Anyway as a previous poster has said best thing to do is ignore the ticket. Not sure if you've replied to the company but with private parking tickets they have to be able to prove your the driver as that is who their contract is with..... Legally you don't have to provide them with details.
Unlike a parking ticket supplied by the council where the owner either has to take responsibility or provide details of the driver by law.

I'm not saying these guys are right; but why does everyone seem to think they have a right to park wherever they want and not pay?

How much is the fine? Because if they lose taking you to court then they're looking at £300 minimum so I'd doubt they would bother tbh. I don't know though so don't take my word for it but they won't take you to court for £80 if its gonna cost them at least £300 in the case of a loss.
Courts are cracking down on dodgy parking companies too so I think the courts tend to favour the driver atm too. It all depends on where and why you got the fine? Whether the signs were clearly set up etc just look the company up and see whether they have any actual legal power over you because they probably don't. However there is always the point that if you've overstayed your time on a carpark theres a technicality with regards to trespassing but I think theyve gone beyond that now and I doubt they can pull it back to that now (plus the court would just laugh at them.)
The big thing though which I do know about is have you told them you were in the car? Have they got proof you were in the car? You are not responsible for your car if driven by someone else and they know that if they cant prove you had the car then they cant fine you. I did actually get out of one of these once based on that as for my first year of driving I was put on my dads car then I got my own after a year and I was caught at a netto car park (claimed Id been there and returned within the 2 hours which was a lie anyway) and sent a letter to my dad who obviously wasnt driving so he just sent a letter saying "i wasnt driving the car that day" they threatened that he must tell who was driving so we went and asked our neighbour in the police and he said we dont have to tell them.

I got my ticket when taking the kids to McDonald's got dinner. I had strayed onto the pizza hut area of the car park completely unaware that there was a difference. I guess the dubious nature of their operation is why they would never dare to take anyone to court.

My 80yr old father in-law got on a couple of years ago, he went to the shop the car park was for and made a purchase then nipped to the bank over the road. Ping! You owe cash. Tell me how that's fair, clearly a paying customer.

| At my old work my mate took his mam to Tescos with a disabled badge, and didn't park in a disabled bay so got a ticket.
The BEN were informed and ticket was recinded.

I'm not defending that type of practice (or defending anything to be honest) and of the two examples given in this thread they sound to me like dubious companies, being con men.
I suppose it was more a general question. For example citywolfs thread on the sin bin was him parking in a stay for 20 minute zone (knowingly) and stayed for 30 minutes and complained he shouldn't pay; those kind of situations was more what I was talking about.

Think you should re-read my post.
At no point did I complain about paying it. Simply asked if I needed to as I moved the car before the ticket was issued.
Incase your wondering I didn't.
