If it is ruled the business has not followed disciplinary processes properly and it does cost £300,000.00 whoever is responsible ultimately should depart which should put the correct message out !

If he wins, that £300,000 is counted on the salary cap over the period of the contract AFAIK.

I will not comment until after the case has finished. I am not in receipt of all the facts and I am sure nobody else who posts on here is.

I think it is blatantly obvious that if you take a case to court through a solicitor you will only be able to claim loss of earnings for money you are actually entitled to.
So wether you agree or not it would appear Mason was on approx 100k a year.

He's not claiming £300k loss of earnings but £300k damages..loss of earnings may make up a proportion of this, i doubt it is the full amount, considering his losses were mitigated by gaining a contract at another club.

Anyone who saw the tweet in question will have all the facts....in graphic detail.

He was on £95,000 a year. I can't see how he can claim loss of earnings on all that because he is currently employed AFAIK (to be fair I haven't studied Employment Law for about 22 years so my knowledge is hazy/out of date) *edit didn't see Espanyol swans post which pretty much says the same thing*. His main beef appears to be a testimonial he was due at the end of the current contract. Apparently Mickey Rourke and Joe Calzaghe had organised events for him and he believed he could earn up to £100,000.

The club are stating that he was not sacked solely for the Twitter picture but for a series of events including the CCup final partying and the fact that he was constantly using "unattractive" language and behaviour on twitter. Also that he tweeted about a product called Muscleforce which is a rival of Muscle King although he claims he gained no money (can't see that's really relevant though although it does suggest a lot about his motivations in life).

His argument is that he was sacked because the club had signed Fielden and Kopczak who, according to Mason's lawyer, are on £55,000 and £60,000 respectively.The club had been trying to get rid of him but he wanted to hang on for his testimonial.

ATEOTD the club much feels it has a strong case or they would have settled out of court which is what happens in the majority of these cases.

The employment law is a complete farce - Having just gone through the thing having stopped employing a nanny due to the children growing up.

They tried to claim £15K because I had not followed the correct procedure (turns out I had). Point is if the club has not followed the correct procedure - to the letter - then they could well get caught out and lose the case

Whoever agreed a £95 k contract for Mason deserves disciplining.

He was a good player but that was too much.

agree the 95k for mason was a very good deal for him...but at the time he was playing well for us

look at ferguson, hes playing well now its his last year, they play for contracts and try for the best deal then a few years in they slack off then in the last year they play well again! cording is another whos shown up well this year (out of contract)

Basically you find a company willing to insure you against losing the case. If you cannot find one to underwrite or its too expensive you settle out of court. Depending on how risky the court case depends on the premium and therefore where you pitch your out of court settlement.

Atleast the OP example is a bit more toned down than this one from Eurosport.

Fielden made his money at the pie dome - he creamed it in off them for years and he's spent 2 years injured so it's not a big shock to find he'd not on megabucks.

From the outside it seems harsh to have sacked Mason for the reasons given but if like has been said it's a series of events then it may have been a 3 strikes rule?

Absolute rubbish. You seriously think a player thinks were he is on the contract front before he decides how hard he tries out on the pitch.
Players play 100 percent every game. Lack of performance is down to factors like injury and confidence or in the case of Ferguson been played out of position. Clubs are not stupid. Do you actually think if a player has a three year contact and he is dire for the first two and a half that playing well for the last six months is going to fool anyone from either the club or any potential future bidders.
