It's correct to say he didn't [ihave[/i to accept the 'new employer' and could have walked away after the buy out. This is the case for any employee in that situation. What is puzzling is that we had a statement [or was it just the T&A report? which used the past tense in a sentence about the staff, with the words 'tuped across' in it. I think there is a fortnight's 'thinking time' but I guess that once you've agreed to it, you can't go back on it later, and the report suggested they [ihad been[/i tuped.

It is actually quite important as it would mean we wouldn't be entitled to ask a fee for the transfer.

Request for information on tupeing of players to a newco please.

First of all is Newco obliged to take all players over? certainly the existing contract terms stay, hence Platt on a lot of money last year, but does the RFL require all players to go across to prevent newco cherry picking?

and point two: in these circumstances do the RFL rules include an embargo on other clubs cherry picking players from those tuped by newco, ie could Koppygate be followed by Carvellgate? it would seem inequitable for newco not to be able to cherry pick but other clubs have a free hand to do so at no cost.

I remember a few of the Glasgow rangers players left the club in this way at the time of their troubles

Sounds like Andy Clarke's been trying to do some deals but any chance of them being done on the quite has been blown out of the water. I wonder how much Carvell himself knows about all this? Does he want away?

It would be interesting to know if all the players have been all formally TUPE'd to the new company. It would also be interesting to know if the new directors were aware of any players wanting away when they issued the "ringfence" statement.

I personal wouldn't be angry with Carvell if he chose to leave. He signed a contract with us in good faith , he could have gone to a number if other clubs but chose to come to us, I'm sure under the promise that financial issues were behind us. We've gone into admin again and considering our history of players not wen paid,
Maybe he decided he didn't want that risk in his later years.

Basic TUPE regulations that apply are found at regulations 4(7) to 4(11). It's complicated but essentially if an employee objects to a transfer it has the effect of terminating the contract which would have been transferred. That forfeits the right to claim dismissal except where there is a substantial change in the working conditions.
The regs are written as if an employees objection must be made before the transfer but cases have shown that when an employee does not know until after the transfer ,an objection is allowed. There's no hard and fast time limit.
Two obvious questions-
Has Carvell made an objection and is he the only objector?
Has there been any move to make "substantial change" to working conditions?

There was "The Shame of Odsal" series of articles in the T&A and we were 48hrs from closure in 1989 under his disastrous leadership. He was eventually persuaded to step aside and let Caisley take the job after a consortium of Bradford businessmen had enough.

Things might be a shambles now but they weren't much better in 85-89.
