Its old news but I'm still not convinced that its strictly legal.

A private individual or company cannot levy "fines" can they ?

A court can, and someone with the authorisation of the court can, but the whole of the banking industry is currently spending millions trying in vain to fight a legal action against them for levying "charges" that are "fines" in disguise simply because they cannot justify a £25 fee for processing a cheque or direct debit - the banks cannot call it a "fine" because they do not have the authority to "fine" people so they dress it up as a "charge" but even so they have to be able to justify it.

So back to the issue - how can a private company levy a fine, and how can they dress up £25 to justify it as a charge for rejecting your card at an automatic turnstile which is specifically designed to do so ?

I think they are on dodgy ground.

The only way I would take a season ticket at Leeds is if Gary brought it round to my house and paid me for taking it.

i always pay cash for my season ticket. can't take it out of my account if they haven't got the details

Really odd thing to say that isn't it. You will get fined £25... why not just not let me in to the ground!!!!

How, exactly, are these fines going to work?

Now I never read the T&C's for season ticket when I got it but I would be very surprised if I have granted Leeds Rugby unfettered access to my bank account so they dip into my cash whenever they see fit to.

It sounds like a load of old tosh designed to stop you trying to use your season tickets when you've not renewed. If this is the case then they really need to address the technology behind their gate entry system because, reading between the lines, you may simply be able to use your existing season ticket next year and it will work!!!

So Leeds have taken to threatening people now.

The thing is - it won't.

Their software is quite sophisticated, (I sell access control equipment) and its a very basic function of any access control system to bar certain cards on demand - I have a membership card that normally will not work at all on the gates but which can (or could) be enabled for one game when I ring the ticket office and pay for one entry.

Its not beyond anyone's intelligence to understand that it should be a simple task to deny access to all members at the end of the season and then re-enable them as they renew, fail-safe, the only downside is that your staff may miss some of the renewals if they are not given the correct information.

As to the fining issue - everything I've read so far suggests that its not legal, even if a company put it in their terms and conditions it is not permissable for a company to levy "fines" - like I've said before, see the state of the banks appeals process at the moment, they have lost at every stage so far.

I did not know you have to retain your card and would have laughed at them loudly if they tried to fine me. In fact buying a season ticket is a should i/shouldnt i decision for me and i would fall off the season ticket fence so easily especially if they try to treat me as a moron. In fact i may lose it just to prove a point. Not even the banks fine you for card changes or losses. Who is there marketing man? he certainly knows how to win customer loyalty. Phil may like to comment. The railway cos seem to manage when someone travels without a valid ticket. How does this differ?
